Winter Storage Terms of Agreement
- Hoty Marine shall remove Boat from the water on haul out date show on front page, or as soon as possible thereafter; shall provide storage to the following May 1. Haul out date shall not be later than November 12 unless other arrangements are made with Marina Management.
- Boat will not be launched and cannot be removed from Marina before all storage, dockage, repair and other charges at the Marina are paid. Boat will be launched on or about May 1 in approximately the inverse order in which it was stored. An earlier launch date will be made if practicable, at the discretion of the Marina; provided however, that if other Boats must be moved to make an earlier launching, the costs of moving such other boats shall be paid by Owner. If a later launch date is desired, Owner shall pay the cost of moving other Boats which may be necessitated thereby and the cost of moving Boat, if required.
- Boat may be moved outside prior to May 1 (weather permitting) to accommodate the spring launch.
- Payment Policy: All winter storage fees are due December 1, unless a payment plan is in place and a deposit has been made.
- Owner shall furnish to the Marina a set of keys to the Boat for haul out and launching purposes.
- Hoty Marine shall not be responsible for, or have any liability whatsoever for, any loss, damage, personal injury or loss of life or property within the control of Hoty Marine, its employees or its agents in connection with (1) the Company’s premises or the use of its storage space; (2) the Owner’s vessel, motor, cradle, and accessories including, but not limited to, dock box, fenders, tools and associated equipment; or (3) any loss due to fire, theft, vandalism, collision, Marina equipment failure, windstorm, rain, tornado or any other casualty loss. Owner agrees to cover the aforesaid risks by appropriate insurance without subrogation against Hoty Marine.
- Boat must ready for launch by June 1.
- Charges for Summer Storage begin May 1. Summer Storage fees will be pro-rated if the boat is removed prior to October 31st.
- No person other than Owner, or the Captain employed by the Owner, shall work on Boat at the Marina during the storage period without the prior approval of the Marina. Such work shall be done during regular working hours of the Marina and at the full responsibility and liability of Owner. Owner shall indemnify and hold Marina harmless for any and all acts or actions of Owner or agents of Owner for damages caused to Marina property or other persons or property by Owner or Owner’s agents. Marina may request proof of insurance on work performed by other than the owner.
- In the event of any emergency, or in the event of non-payment when due, Hoty Marine shall have the right to move Boat to any other available location.
- Owner shall not place a sign on the Boat advertising it for sale at the Marina.
- Owner, his agents, employees and guests shall comply with all rules and regulations established by Hoty Marine and shall not engage in immoral or illegal activities at the Marina which are in violation of any city, county, state or federal law or ordinance.
- Should a Boat have no bottom paint other than antifouling paint, an additional charge will be made at our regular hourly labor rates, ($76 per hour) for bottom scrub.
- Owner understands and agrees that Hoty Marine will use best efforts to place boat at desired storage location. However, Hoty Marine reserves the right to store the boat at any facility operated or controlled by Hoty Marine and location of the boat in any specific storage area remains at the discretion of Hoty Marine. Electrical and water hookups in storage areas will not necessarily be provided by the storage facility.
- All batteries must be removed or disconnected from Boat during winter storage.
- On all sailboats - sail rigging must be removed by Owner before Boat is hauled out. Removal and resetting of mast is done completely at Owner's risk and regular hourly labor rates will be charged until mast is placed on storage rack or stepped. Hoty Marine will not be responsible for lost mast parts.
- Owner understands and agrees that Hoty Marine will not be responsible for failure to perform services not requested in the contract by Owner, including failure to winterize.
- This agreement must be signed by Owner and returned to the Marina.
