Hoty Marine Harbor Rules
The following rules have been adopted to provide a safe and inviting Marina for all. These rules are expressly made a part of any dock, rack or storage Agreement by and between Owner and Marina. Owner is responsible for communicating Harbor Rules to its family, crew, guests, contractors and other invitees (“Guests”) and ensuring they abide by the same. Failure of Owner or Guests to comply may result in termination of Owner’s Agreement without refund. Marina maintains the right to modify these Rules from time to time for the safety, care and cleanliness of the Marina and the preservation of good order.
COURTESIES
- All persons in the Marina shall conduct themselves with decorum as the same is defined in the Marina’s sole discretion. Public intoxication, depravity, profanity, abusive language, threats, harm or injury to persons or property, whether on Marina property or elsewhere is not acceptable.
- Quiet hours are between 11:00 P.M. and 7:00 A.M. At all times, noise, including the playing of music, should be kept to a minimum. All persons at the Marina shall use discretion in operating engines, generators, radios and television sets, so as not to create a nuisance or disturbance.
- Pets must be controlled by Owner and must be on a leash or held while on the dock or other common areas. Pets are not permitted inside any building and may not be tied to docks, sidewalks or other fixtures. Owner is responsible for cleaning up pet waste. Constant barking is prohibited.
- Commercial activities are not permitted within the Marina. Solicitation or advertising within the Marina, even on personal vessels, is strictly prohibited, unless specifically authorized in writing by the Marina Management.
GUESTS
- All guests (including contractors) must be escorted through the security gate by Owner. Owner shall not provide guests a key fob or other security code or otherwise circumvent security measures in place.
- Marina reserves the right to limit parking to Owners only.
- Docks within the Marina are for the use of the registered Owner only. Guests may request and pay for transient dockage at the Marina Office, if available.
HEALTH AND SAFETY
- Violation of any city, state or federal rules, regulations, laws or ordinances is strictly prohibited within the Marina.
- Owner is not permitted to discharge or release (voluntarily or involuntarily) holding tanks or toilets, oil, spirits, flammable material, paint, bilges or other hazardous materials, into the Marina basin or property, including trash receptacles. Please ask Marina personnel for assistance in disposing of waste oil. Owner must immediately report any discharge or release to Marina management and is responsible for all costs of clean-up or maintenance resulting from the discharge and/or release.
- Refuse and garbage must be contained in plastic bags and deposited in provided trash receptacles. Please ask Marina personnel for assistance in disposing of larger items.
- Vessels may not be fueled on land or in the Marina basin. Fueling a vessel is only permitted at the Marina’s fuel pier with marina tanks and equipment.
- All Vessels must proceed at idle, no wake speed, while in the Marina basin so as to prevent damage or injury to persons or property. Any damage or injury to persons or property resulting from violation of this paragraph shall be the sole responsibility of Owner.
- Vessels with bow pulpits or other extending objects from the bow or stern must be tied back so as not to extend into a pier; Vessels with swim platforms, outboard motors, rudders, and other extending objects from the stern must not extend into the fairway. Vessels which exceed the dock’s length must be moved to a larger dock at the owner’s expense.
- Swimming, diving and fishing are all prohibited within the Marina basin. Fish cleaning is also prohibited within the Marina.
- Shoes must be worn when walking on the Marina piers, docks, common grounds or through buildings.
- Fireworks, firearms and weapons of any kind are not permitted within the Marina at any time.
- Children should be accompanied by an adult when on the docks and should be wearing an approved PFD.
COMMON AREAS
- Pool hours are as posted by Marina management. Children under 13 years of age must be accompanied by an adult.
- Open fires are not permitted on docks, piers, or boats. Grills are provided.
DOCKS
- Owner shall immediately report loss or damage to Marina property and are responsible for any and all damages caused by Owner or its Vessel and the resulting repairs, replacements or maintenance required.
- Boats found in unassigned docks will be moved at the Owner’s expense.
- Should Owner’s Vessel sink or submerge in the Marina, Owner agrees to remove the Vessel at Owner’s expense within 24 hours. Marina may move or have the Vessel removed at the Owner’s cost in the event of an emergency. Any Vessel experiencing more than normal leakage must be repaired or removed from the Marina.
- Marina assumes no responsibility for improperly moored Vessels or improperly tied lines.
- Rub posts should not be used as handrails.
- Docks and piers shall be kept clear of stored materials. Boat Owners shall not store supplies, materials, accessories or debris on walkways. All dock boxes must be furnished or approved by Marina Management. Installation must be performed by Marina personnel to prevent damage to the pier. Avoid running hoses and electric lines across the docks.
- Dockcarts must be returned to the designated area after each use. Do not use carts on docks, only along piers.
- Laundry should not be hung on boats, docks or piers.
- Skates, skateboards, longboards, bicycles and other similar forms of transportation are not permitted to be ridden on piers.
- Only fenders manufactured for vessel use are permitted. Homemade fenders and ties are prohibited.
- Repair and maintenance of docks and piers must be performed by Marina personnel only. Owners may not alter docks or piers in any way.
YOUR BOAT
- All Vessels, whether on land or water, must be maintained in a safe and clean manner. Owner’s Vessel must meet minimum state and local regulations and must be able to pass a Coast Guard inspection. If Owner is unable or unwilling to bring the Vessel up to standard, the Vessel must be removed from the Marina property at Owner’s expense with no refund.
- Routine maintenance and minor repair necessary for the preservation and seaworthiness of the Vessel such as mechanical adjustments, minor painting, leak seals and rot prevention may be performed within the Marina. Routine maintenance and minor repairs are generally considered to be those which do not disturb the public peace and tranquility of any person aboard any boat within the Marina. The Marina will not loan tools, equipment or supplies to Owners. No outside contractor may work on any boat in the Marina without prior consent of the Owner and Marina Management. Outside contractors must provide proof of insurance and check-in and out at the Marina Office. All such routine maintenance and minor repair by Boat Owners, operators or permitted outside contractors may be performed only between 8:00 A.M. and 4:00 P.M., except in the case of an emergency.
- The Marina will take reasonable measures to maintain adequate depth in the Marina, but will not be responsible for vessels stranded or hitting bottom. Due to the constantly changing water levels, the Marina will not refund fees collected if the Vessel’s draft exceeds the basin’s or channel water depth.
- Water supply hoses of unattended Vessels shall be disconnected at the dock and stowed aboard.
- Water and electricity must not be wasted; additional charges will be added to the slip rent of any Owner using excessive amounts of electricity or water.
- Only manufactured marine electrical cords and adaptors are approved and may be used in the Marina.
- Owner must provide their current federal documentation or state registration numbers for all vessels berthed in the Marina.
PARKING
- Marina does not warrant availability of parking. Priority parking is granted to Owners.
- Vehicles parked in “No Parking” areas or areas that are not designated as parking spaces will be towed at Owner’s expense.
- Marina disclaims any responsibility for vehicles parked on Marina property, including but not limited to damage from theft.
